ACCIDENTAL & MALICIOUS PRODUCT CONTAMINATION

To protect themselves from catastrophic loss, food and product manufacturers will procure insurance policies in the event their product becomes contaminated. The policies can extend to cover contamination or mislabeling of products during the production process that can pose a threat if consumed. In many instances, food and product manufacturers will decide to voluntarily recall products after a potential contamination is noticed.

Claims include:

  • Bacterial contamination, including Listeria, Monocytogenes, Salmonella, E.coli.
  • Product mislabeling (omission of an ingredient that is an allergen)
  • Foreign objects in products (metal, plastic, glass)

EXPERIENCE

  • Premier’s adjusters have successfully settled over 1,000 product contamination claims
  • We have adjusted claims ranging in value from $50,000 to $50,000,000.
  • We actively pursue subrogation efforts against third-parties and/or their insurers.

We are adept at controlling costs and losses during the adjustment process.

HANDLING PRODUCT CONTAMINATION CLAIMS

When a Product Contamination claim is submitted we immediately respond to assist the Insured with identifying and eliminating the source of the contamination.

In the example above, we assisted a food processor who discovered microbiological contamination in their food product.  We collected samples of the product and swabs of food contact surfaces which were sent to a lab for testing.  We successfully isolated and eliminated the source of the contamination and assisted the Insured with upgrading their sanitation, food safety and quality control procedures.

The adjustment process confirms the covered and excluded costs related to:

  • Recall expenses (including product value)
  • Rehabilitation expenses
  • Crisis response expenses
  • Lost gross profits
  • Subrogation and other Insurance

During the claim process, we focus on ensuring that responsible parties are placed on noticed and actively pursue recovery and contribution from suppliers, contractors and other Insurers.
